Refund Policy

General Memberships, Race Licences and Technical Licenses: Partial refunds will only be issued in the event of Bicycle Nova Scotia overcharging an applicant.  In such an event, the balance of the amount erroneously charged in excess of the amount due will be refunded to the applicant with our apologies.  Full refunds will not be issued.

 Privacy Policy

Bicycle Nova Scotia falls under the jurisdiction of the Personal Information Protection and Electronic Documents Act of Canada.  The complete Act may be accessed at http://laws.justice.gc.ca/eng/P-8.6/FullText.html for your information.  What follows is an outline of our privacy policy as required by law, and, of course, by our concern for the rights of our members.

1. Purpose of the Policy
Bicycle Nova Scotia (“BNS”) collects personal information in the course of administering the sport of cycling in Nova Scotia, when we provide you with services, and when you:

  1. Become a licensed member;
  2. Subscribe to, or seek to be registered in or for, BNS programs or newsletters; and access the BNS website.

 We most commonly collect personal information in relation to cycling participants, including without limitation cyclists, officials, members, spectators, supporters, subscribers to our newsletters and promotional offers, and other persons.

The types of personal information we may collect depends on the purpose for which it has been collected, but may include your name, address, email address, telephone number, cycling history, purchasing preferences and financial details, among other things. We may also collect sensitive information about you (for example health information) where you consent; the collection is required by law or for insurance purposes; the collection is necessary for your health and safety, or to establish, exercise or defend a legal or equitable claim.

Generally, if appropriate, we will tell you why we are collecting personal information and how we plan to use it, or these things will be obvious when we collect the information.

2. Use and Disclosure
BNS uses personal information about you for the following primary purposes:

  1. administration of cycling in Nova Scotia;
  2. registration, selection and insurance purposes;
  3. provision of cycling activities and services;
  4. assessing the level of interest in cycling; and
  5. provision of BNS’ and general cycling information, materials, and promotional opportunities to you.

When you visit our website, BNS may record anonymous information which tells us about visitors to our website but not the identity of those visitors. For example, we may collect information about the date, time and duration of visits and which pages of our website are most commonly accessed to help us gauge the usage of our website. We may also use “cookies.” These are small pieces of information that allow an organization to track the websites browsed by a person and customize website information to that person’s requirements and interests. You may be able to adjust your internet browser to disable cookies. If you do so, you may not be able to access some areas of our website or take advantage of the improved functionalities that cookies enable.

BNS may use your personal information for direct marketing where it is impracticable for us to obtain your prior written consent. When we do so, however, we will provide an express option for you to decline receiving any further marketing communications from us.

We may from time to time disclose your personal information to our service providers, agents and contractors to help us provide and market services to you. If we do this, we generally require these parties to protect your information in the same way we do.

In some cases we may transfer personal information about you to someone who is in a foreign country (for example, the UCI Headquarters in Switzerland).

3. Security
BNS will also take reasonable steps to protect your personal information from misuse, loss and unauthorized access, modification or disclosure. However, as the internet is not a secure environment, any information you send us online is sent at your own risk.

Our website may contain links which enable you to access other websites. We are not responsible for the content or privacy practices of those sites.

We will take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for any purpose for which the information may be used or disclosed and if we are no longer obliged at law to retain that information.

4. Access, Correction, and Inquiries
BNS will take reasonable steps to make sure that the personal information we hold on you is accurate, complete and up-to-date. If you think that any information we hold about you is inaccurate, please contact us.

In some circumstances you may gain access to the personal information which BNS holds on you. If you wish to know what sort of personal information BNS holds in relation to you, for what purposes it is held, and how we collect, hold, use and disclose that information, please contact us. Before supplying any personal information to you we must be reasonably satisfied as to your identity (for example, by having sighted a copy of your driver’s license). BNS is not under any obligation to provide personal information to you where we are not required.

All correction and access requests should be placed in writing and should set out as much information as you can about the information you seek, in order to help us retrieve it. We may charge an access fee to cover our costs of supplying personal information to you.

Terms of Use

We reserve the right to change the Terms of Use (“the Terms”) at any time.  By using the Bicycle Nova Scotia (“BNS”) website (“the Site”) in the future, you agree to follow and be bound by the Terms as they then exist.

Site Contents
You should assume all information (the “Contents”) presented is subject to copyright and owned by BNS, unless otherwise indicated.  The Contents includes all images, illustrations, designs, icons, photographs, trademarks, logos, text, software, sounds, music, the Site as a whole, and any other components that comprise the Site or are conveyed by or upon it.

You may use or download the Contents solely for your personal, non-commercial purposes, provided you keep all copyright and other proprietary notices with them. No other type of use is permitted. Downloading or copying Content does not transfer any right, title or interest in any Content to you. The downloading or export of software or technical data from this Site to any jurisdiction in violation of Canadian export laws is strictly prohibited.

User Submissions
You promise that no information or material you transmit to BNS will violate anyone else’s right, including copyright, trademark, privacy or other rights. You may not transmit any information that is or contains threatening, libelous, defamatory, scandalous, inflammatory, pornographic, profane or otherwise unlawful, abusive or obscene material. You shall be solely responsible for the content of any Comments you make. BNS is not responsible or liable for the content of information that others post at or transmit to the Site, for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography or profanity contained in any such information, or for the conduct of any Site user.

Links to Other Sites
If you have any concerns regarding any outside site linked to or from the site, please direct them to the owner or operator of the site.  BNS is not responsible for any outside sites, services or other materials linked to or from the Site, and disclaims all liability for any injury you may experience by using such materials.

Disclaimer
Your use of the Site is at your own risk. BNS PROVIDES THIS SITE, ALL CONTENTS, AND ALL SERVICES OFFERED THROUGH OR FROM THE SITE AS IS WITHOUT EXPRESS OR IMPLIED WARRANTY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. Miscellaneous
Unless otherwise specified, BNS displays this Site and the Contents solely to market and promote BNS’ services in Nova Scotia.  BNS controls and operates this Site from its offices in Halifax, Nova Scotia, Canada.

These Terms shall be construed according to Canadian Law, without regard to conflicts of laws. Any dispute arising under or relating to these Terms, the Contents, the use of the Site, or products or services purchased using this Site, shall be resolved exclusively by the provincial courts of Nova Scotia, Canada. Your use of the Site constitutes your consent to the jurisdiction and venue of said courts with respect to any such dispute.

These Terms are the entire agreement between you and BNS relating to the Site or its Contents. Any other agreements between you and BNS are superseded and have no force or effect.

Termination
If BNS believes you have failed to comply with these Terms, or for any other or no reason, BNS may deny you access to the Site immediately without notice. The restrictions, including restrictions with respect to the Content, disclaimers and liability limitations in these Terms shall continue to apply. Upon denial of access, you must promptly destroy all Content downloaded or obtained from this Site, as well as all copies of any Content.
